Holiday Illness Claims

Walkers Solicitors are specialists in holiday illness claims.

If you have been on a package holiday within the past three years, and if you have suffered with food poisoning or any other gastrointestinal illness then you may be able to make a claim for compensation.

The Package Travel, Package Holidays and Package Tour Regulations 1992 allow you to pursue your tour operator for compensation as a result of an illness or injury that was not your fault.  It is your tour operator’s responsibility to ensure that they take all reasonable steps to make sure that holiday makers health and safety is not compromised or put at risk.

All too often, holidaymakers are told that it is normal to get ill whilst they are abroad due to the change in temperature for example.  This is not correct and a lot of the illnesses which are contracted are preventable.

Some of the well-known causes of holiday illnesses include:

  • Recycling food

  • Poor sanitation

  • Serving raw or undercooked meats

  • Cross contamination of food

  • Non-filtered water being used for ice in drinks and/or washing vegetables/salads

  • Food not being stored at the correct temperature

If the food poisoning or illness took place whilst you were on a package holiday whether it was in a hotel or on a cruise ship, then you can usually always make a claim in the UK against the tour operator.

As well as claiming compensation for the illness you have suffered, you may be able to claim for additional items such as:

  • Medical treatment fees

  • Prescription charges

  • Loss of earnings

  • Out of pocket expenses

  • Cost of cancelled excursions

Holiday illness claims can be made on a no-win, no-fee basis.
